About Colorado Adoption Law

The Colorado Constitution and Colorado Revised Statutes are available online at www.michie.com/colorado

Colorado’s Children’s Code is found under Title 19. Article 5 deals with relinquishment and adoption, and Part 3 of Article 5 addresses access to adoption information.

The Colorado Children’s Code (19-1-103)(6.5)(a) defines the adoption record as the following:

  • The adoptee’s original birth certificate and amended birth certificate
  • The final decree of adoption
  • The final order of relinquishment and the order of termination of parental rights

To obtain these documents, you may contact the COURT where your adoption was finalized as this is the entity that is defined as the Custodian of the Record.  Oftentimes the court record does not include birth certificates and therefore you may contact Colorado Vital Records at https://www.colorado.gov/pacific/cdphe/adoption for more information on how to gain access or call 303-692-2226.

Recent Changes in Colorado law regarding access to adoptee documents:

In addition to these services we want to inform you of recent changes to Colorado law that may allow you to obtain certain adoption information.  Per legislation that was enacted in 2014, adoptees may have access to documents from their adoption record. Effective 1/1/2016, adoption records were opened. This means that original birth certificates became available to adoptees regardless of when the adoption took place.

For adoptees, this means you can access your original birth certificate and other court documents related to your adoption. These records would have identifying information about your birth parents.

For birth parents, this means that you can access the original birth certificate for your child and relinquishment paperwork. None of the documents that birth parents receive contain identifying information about the adoptee or adoptive family.

Post-Adoption Services offered by Catholic Charities

Search Only Services for Non-Identifying Information

The Non-Identifying summary of information provides details about the person sought, including physical characteristics, known medical issues and social/educational issues, as they were reported at the time of the relinquishment or adoption.  Occasionally, contact has been made in the years since the relinquishment or adoption and we have limited updated information. The information provided in the Non-Identifying summary does not provide names, birth dates, or any information that would reveal identity or clues to identity. Information will be relayed to the searcher via a letter from the agency.

Search and Reunion Services for Non-Identifying Information

Search and Reunion services are provided by our agency to adoptees and birth parents who worked with our agency at the time of the placement for adoption and for whom this agency holds records. We can conduct a search on behalf of the party who initiates the request.  This process may involve contacting the person who is being sought and, with his/her consent, providing identifying information which may lead to contact between the searching and sought parties.
